Our firm represented a high-end custom homebuilder in a dispute with its client that arose mid-construction of a luxury residence. During the construction process, the homeowner asserted claims of alleged defects and deficiencies, despite the project being ongoing and the purported issues either not constituting defects at all or being readily correctable in the ordinary course of construction or on a punch list.
The dispute presented common but challenging issues in residential construction litigation, including premature defect claims, misunderstandings regarding construction sequencing, and the proper allocation of risk and responsibility during an active build. Rather than allowing the builder to complete the work and address any legitimate punch-list items, the client escalated the dispute, creating uncertainty and disruption to the project.

We also positioned the case strategically for mediation by methodically addressing both the legal and practical realities of completing a complex custom home project.
Ultimately, through disciplined advocacy and persistence, the matter was resolved in a manner that allowed all parties to move forward. The resolution avoided further escalation, provided closure to the dispute, and enabled the project and the parties’ respective interests to be addressed pragmatically.
